Kiambumart Terms and Conditions

Effective date: October 2026 Last updated: October 2026

1. About these Terms

These Terms and Conditions (“Terms“) govern your access to and use of Kiambumart, an online business directory and marketplace for Kiambu County, Kenya, available at [www.kiambumart.com] and through any related web or mobile applications (the “Platform“).

The Platform is operated by [Registered legal name of operating entity], registration no. [number], of [physical address], Kenya (“Kiambumart“, “we“, “us“, “our“).

By accessing the Platform, creating an account, or listing a business, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into them. If you do not agree, do not use the Platform.

2. Definitions

  • “User”: anyone who visits or uses the Platform.
  • “Business Owner”: a User who creates an account or a business profile.
  • “Listing”: a business profile and any related content, including offers, products, services and photos.
  • “Plan”: the Free, Standard or Featured plan, or any other plan we offer.
  • “Featured Slot”: a placement that promotes a Listing more prominently, as described in your Plan.
  • “Content”: text, images, logos, reviews, messages and any other material posted on the Platform.

3. Our role

Kiambumart is an online directory and listing platform. We help people find businesses and help businesses be found.

  • We are not a party to any transaction, agreement or dispute between a Business Owner and a customer.
  • We do not sell, own, inspect, store, deliver or guarantee any goods or services listed on the Platform.
  • We do not act as an agent, employer, partner or joint venturer of any Business Owner.
  • Unless we expressly say otherwise, we do not handle payments between customers and businesses.

4. Eligibility and accounts

  1. You must be at least 18 years old and legally able to enter a binding contract under Kenyan law.
  2. If you register on behalf of a business, you confirm that you are authorised to bind that business to these Terms.
  3. You must give accurate, current and complete information and keep it up to date.
  4. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at [support@kiambumart.com] if you suspect unauthorised use.
  5. One business may have only one active primary Listing per location unless we agree otherwise. Duplicate or misleading accounts may be merged or removed.
  6. We may verify your identity or business (for example by requesting a business registration certificate, a county business permit, or ID) and may refuse or remove a Listing that cannot be verified.

5. Listings

5.1 Free profile

Every Business Owner may create a basic business profile free of charge (the Free Plan). Features available on the Free Plan may be limited compared with paid Plans.

5.2 Search visibility and featured placement

  • Search visibility. After our launch period, appearing in directory search results may depend on your Plan. Businesses on the Free Plan will have a profile but may not appear in search results unless they upgrade to a paid Plan. [Describe how Free Plan listings can still be reached, e.g. by direct link, category browse or business name.]
  • Featured Slots. Paid Plans include a set number of Featured Slots for promoting your Listing, as shown on the Platform’s pricing page.
  • No guaranteed ranking. Paying for a Plan does not guarantee a particular position, number of views, enquiries, customers or sales. Search results and ordering may depend on relevance, location, category, quality of the profile and other factors, and we may change our ranking methods at any time.
  • Launch period. We may launch the Platform in phases and may turn on paid search visibility once we reach a target number of onboarded businesses. We will give Business Owners at least [14] days’ notice on the Platform or by email or SMS before that change takes effect.

5.3 Your responsibility for Listings

You are solely responsible for the accuracy, legality and completeness of your Listings, including prices, availability, descriptions, contact details and any claims about your business. You confirm that:

  • you own or have the right to use all Content you post, including logos, photos and trademarks;
  • your business is lawfully operating in Kenya and holds every licence, permit and registration required for the goods or services you offer (including county business permits and any sector-specific approvals); and
  • your Listing complies with all applicable laws, including the Consumer Protection Act, 2012.

6. Plans, fees and payment

  1. Current Plans and prices (in Kenya Shillings) are:
Plan Price Featured Slots
Free KSh 0 None
Standard KSh 540 per month or KSh 5,000 per year 10
Featured KSh 750 per month or KSh 7,000 per year 25
  1. Prices are [inclusive / exclusive] of VAT and other applicable taxes. [Confirm treatment.]
  2. Fees are payable in advance through the payment methods shown on the Platform (for example M-Pesa or other approved methods). Payments are processed by third-party providers whose own terms also apply.
  3. Renewal. [Plans renew automatically at the end of each billing period unless you cancel before renewal / Plans do not renew automatically, and we will remind you before they expire.] [Choose one.]
  4. Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current paid period, and your Listing then reverts to the Free Plan.
  5. Refunds. Fees are non-refundable except where required by law or where we fail to provide the paid service through our fault. Annual Plans are not refunded pro rata after [7] days from purchase. [Adjust as needed.]
  6. Price changes. We may change prices or Plan features. Changes apply from your next renewal, and we will give you at least [30] days’ notice.
  7. Non-payment. If a payment fails or is overdue, we may downgrade your Listing to the Free Plan, suspend paid features, or remove Featured Slots until payment is made.
  8. Unlimited or unused slots. Unused Featured Slots do not roll over or earn a refund.

7. Rules for using the Platform

You must not, and must not allow anyone else to:

  1. post false, misleading, fraudulent, defamatory or deceptive Content, including fake reviews or fake businesses;
  2. list goods or services that are illegal in Kenya, or that we prohibit. This includes counterfeit goods, stolen goods, unlicensed firearms, illegal drugs and pharmaceuticals, wildlife products, adult sexual content, and scams or pyramid schemes;
  3. impersonate any person or business, or misrepresent your affiliation;
  4. infringe anyone’s intellectual property, privacy or other rights;
  5. post another person’s personal data without a lawful basis;
  6. harass, threaten, abuse, discriminate against or incite hatred or violence against any person or group;
  7. upload viruses or malicious code, or attempt to hack, overload, scrape, reverse engineer or otherwise interfere with the Platform (in breach of the Computer Misuse and Cybercrimes Act, 2018);
  8. use bots, automated tools or data harvesting to copy the directory or contact Business Owners in bulk;
  9. manipulate reviews, ratings, search results or Featured Slots, including by creating multiple accounts;
  10. use the Platform to send spam or unsolicited commercial messages; or
  11. use the Platform for any unlawful purpose.

We may investigate breaches and cooperate with law enforcement.

8. Content and licence

  1. You own your Content. You keep ownership of everything you post.
  2. Licence to us. By posting Content, you grant Kiambumart a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, display, reproduce, adapt (for example resize), distribute and promote your Content on the Platform and in our marketing (such as social media posts featuring your business), for as long as your Content is on the Platform and for a reasonable period afterwards for backups and legal purposes.
  3. Our property. The Platform, its design, software, trademarks, logos, databases and all Content we create belong to us or our licensors. Nothing in these Terms transfers any of our intellectual property to you. You may not copy or reuse our data or branding without our written permission.
  4. Removal. We may remove or restrict any Content at our discretion, particularly if it breaches these Terms, the law or third-party rights.

9. Reviews and ratings

Users may post honest reviews based on genuine experience. Business Owners must not pay for, incentivise, write or manipulate reviews of their own business or their competitors. We may moderate, refuse or remove reviews, but we are not obliged to. We do not verify every review and are not responsible for their accuracy.

10. Dealings between users and businesses

  • Any purchase, agreement or communication between a customer and a business is strictly between them.
  • We do not guarantee the quality, safety, legality or delivery of any goods or services, or the identity or honesty of any User.
  • Users should take normal care: verify businesses, meet in safe public places where relevant, avoid paying in full in advance to unknown parties, and never share PINs or passwords.
  • Any dispute must be resolved directly between the parties. We may, but are not required to, help by sharing information as allowed by law.

11. Intellectual property complaints

If you believe Content on the Platform infringes your copyright or other rights, email [legal@kiambumart.com] with your contact details, a description of the material and where it appears, proof of your rights, and a statement that you are the rights holder or authorised to act for them. We may remove material and notify the poster. Repeat infringers may have their accounts closed.

12. Privacy and data protection

We handle personal data in line with our Privacy Policy and the Data Protection Act, 2019. As a Business Owner, when you receive personal data of customers through the Platform (for example enquiries), you are responsible for handling that data lawfully and for using it only for the purpose it was provided.

13. Suspension and termination

  1. By you. You may close your account at any time from your account settings or by contacting us.
  2. By us. We may suspend, restrict or terminate your account or any Listing, with or without notice, if you breach these Terms or the law, if we suspect fraud or misuse, if fees are unpaid, if required by law or a regulator, or if we discontinue the Platform.
  3. Effect. On termination your right to use the Platform ends. Paid fees are not refunded except as set out in section 6 or required by law. Sections that by their nature should survive (including ownership, licences, payment obligations, disclaimers, liability and governing law) will survive.

14. Disclaimers

The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, we do not promise that:

  • the Platform will be uninterrupted, secure or error-free;
  • Listings, Content or search results are accurate, complete, current or lawful;
  • you will receive any number of enquiries, customers or sales; or
  • any Content or Business Owner is trustworthy.

Nothing in these Terms excludes rights you may have under the Consumer Protection Act, 2012 or other law that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by Kenyan law:

  1. Kiambumart is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill or data, arising from your use of, or inability to use, the Platform, or from any dealing with another User.
  2. Our total liability to you for any claim relating to the Platform is limited to the fees you paid us in the [12] months before the event giving rise to the claim (or KSh [10,000] if you paid no fees).
  3. Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited by law.

16. Indemnity

You agree to indemnify and hold harmless Kiambumart, its directors, employees and partners from any claims, losses, damages, fines and reasonable legal costs arising from your Content or Listings, your breach of these Terms or the law, or your dealings with customers or third parties.

17. Third-party services and links

The Platform may include links to third-party websites, payment providers and other services. We do not control and are not responsible for them. Your use of them is at your own risk and subject to their terms.

18. Changes to the Platform and these Terms

We may modify, suspend or discontinue any part of the Platform at any time. We may also update these Terms. We will notify you of material changes on the Platform or by email or SMS, and the “Last updated” date will change. If you continue to use the Platform after the effective date of a change, you accept the updated Terms. If you do not agree, you must stop using the Platform and may close your account.

19. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including power or internet outages, network or mobile money downtime, natural disasters, government action, strikes, or cyberattacks.

20. Notices

We may give notice by posting on the Platform, or by email, SMS or WhatsApp to the details in your account. You may contact us at [support@kiambumart.com] or [physical address]. Legal notices to us should be sent to [legal@kiambumart.com].

21. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us on their subject.
  • Severability. If any provision is held invalid, the rest remains in force.
  • No waiver. A delay or failure to enforce a right is not a waiver of it.
  • Assignment. You may not transfer your rights under these Terms without our written consent. We may assign ours to a successor or affiliate.
  • No third-party rights. These Terms do not give rights to anyone who is not a party.
  • Language. These Terms are in English. Any translation is for convenience only, and the English version prevails.

22. Governing law and dispute resolution
